Terms of Service

⚠️ Important: By using piisafe.eu, you agree to these Terms of Service. If you do not agree, do not use the service.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of piisafe.eu ("Service"), a free website PII scanner operated by Zenya Renewables B.V. ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Service Description

piisafe.eu provides a free web-based tool for scanning websites to detect exposed personally identifiable information (PII). The Service:

  • Analyzes website content for 320+ PII entity types
  • Provides risk grading (A-F) based on exposure levels
  • Generates exportable reports (HTML, JSON, CSV)
  • Does not store scan results or user data (zero-storage architecture)
  • Is powered by the cloak.business detection API

Free Tier Limitations:

  • 10 scans per hour per IP address
  • Up to 10 pages per scan
  • No registration required
  • Results delivered to browser only (not stored)

3. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in compliance with these Terms. You must NOT:

3.1 Prohibited Activities

  • Scan unauthorized websites: Only scan websites you own or have explicit permission to scan
  • Circumvent rate limits: No use of VPNs, proxies, or other methods to bypass rate limiting
  • Automate excessively: No automated scraping, botting, or high-frequency API calls
  • Scan illegal content: No scanning of child sexual abuse material, malware, or other illegal content
  • Attack the Service: No DDoS, penetration testing, or security testing without prior written consent
  • Reverse engineer: No attempts to reverse engineer, decompile, or extract detection patterns
  • Resell or redistribute: No commercial redistribution of scan results or API access

3.2 Compliance with Laws

You are solely responsible for ensuring your use of the Service complies with all applicable laws, including but not limited to:

  • GDPR (EU General Data Protection Regulation)
  • CCPA (California Consumer Privacy Act)
  • COPPA (Children's Online Privacy Protection Act)
  • Computer Fraud and Abuse Act (CFAA)
  • Applicable anti-hacking and cybersecurity laws

4. User Responsibilities

As a user of the Service, you are responsible for:

  • Authorization: Ensuring you have legal authority to scan the websites you analyze
  • Accuracy: Verifying scan results independently (see Section 6: Disclaimers)
  • Data Handling: Properly securing any exported reports containing sensitive information
  • Compliance Actions: Taking appropriate remediation actions based on scan findings
  • API Key Security: Keeping your cloak.business API key confidential (if using a personal key)

5. Intellectual Property

5.1 Our Intellectual Property

The Service, including all detection patterns, algorithms, software code, user interface, and branding, is owned by Zenya Renewables B.V. and protected by copyright, trademark, and other intellectual property laws.

Detection patterns are proprietary to cloak.business and licensed for use in this Service.

5.2 Your Content

You retain all rights to the websites and content you scan. We do not claim ownership of your data.

By using the Service, you grant us a limited, non-exclusive license to process your scan requests for the sole purpose of providing the Service. This license terminates when the scan completes.

5.3 Scan Results

Scan results (reports, findings, risk grades) are provided to you for your internal use. You may use scan results for compliance documentation, remediation planning, and audit reporting.

6. Disclaimers and Warranties

6.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of scan results
  • Uninterrupted or error-free operation

6.2 Detection Accuracy

Important Limitations:

  • The Service uses deterministic pattern matching, which may produce false positives or false negatives
  • No PII scanner can detect 100% of all exposed personal information
  • You must independently verify scan results before taking compliance actions
  • The Service does not constitute legal advice or compliance certification
  • Risk grades (A-F) are advisory only and not legally binding

6.3 Not a Substitute for Professional Advice

The Service is a technical tool, not a compliance consultant. Scan results should be reviewed by qualified legal, privacy, or information security professionals before making compliance decisions.

7. Limitation of Liability

7.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENYA RENEWABLES B.V. SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Regulatory fines or penalties resulting from scan results
  • Data breaches or privacy violations discovered (or not discovered) by the Service
  • Damages arising from reliance on scan results

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED €100 (ONE HUNDRED EUROS).

7.2 Indemnification

You agree to indemnify, defend, and hold harmless Zenya Renewables B.V., its affiliates, and licensors from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your scanning of websites without proper authorization
  • Your violation of applicable laws or third-party rights

8. Service Availability and Modifications

8.1 No Uptime Guarantee

The free tier Service does not include uptime guarantees or service level agreements (SLAs). We may suspend, modify, or discontinue the Service at any time without notice.

8.2 Rate Limiting

We reserve the right to adjust rate limits to ensure fair usage and service availability. Current limits:

  • 10 scans per hour per IP address
  • 10 pages per scan
  • Subject to change without notice

8.3 Modifications to Service

We may modify the Service, including detection patterns, entity types, or features, at our discretion. Material changes will be communicated via email or website notice.

9. Termination

9.1 Termination by You

You may stop using the Service at any time. Simply close your browser and clear any stored API keys.

9.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service immediately, without notice, if:

  • You violate these Terms or our Acceptable Use Policy
  • You engage in abusive, fraudulent, or illegal activity
  • Your usage creates security or performance risks for other users
  • Required by law or legal process

9.3 Effect of Termination

Upon termination:

  • Your right to use the Service ends immediately
  • Any API keys you provided are invalidated (on our side)
  • Sections 5-7 and 10-12 of these Terms survive termination

10. Governing Law and Jurisdiction

10.1 Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

10.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.

10.3 EU Consumer Rights

If you are a consumer in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be effective upon posting to this page with an updated "Last Updated" date.

Material Changes: For significant changes, we will provide notice via:

  • Email notification (if applicable)
  • Prominent website banner
  • At least 30 days' advance notice

Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zenya Renewables B.V. regarding the Service.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.3 No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

12.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemic, or infrastructure failures.
